The legitimacy of conscientious objection to abortion continues to fuel heated debate in Italy. In two recent decisions, the European Committee for Social Rights underlined that conscientious objection places safe, legal, and accessible care and services out of reach for most Italian women and that the measures that Italy has adopted to guarantee free access to abortion services are inadequate. Nevertheless, the Ministry of Health states that current Italian legislation, if appropriately applied, accommodates both the right to conscientious objection and (...) the right to voluntary abortion. One empirical argument used to demonstrate that conscientious objection does not create barriers to abortion is the “no correlation” argument, which the Italian Committee for Bioethics employed to demonstrate that no association exists between conscientious objection and waiting times for voluntary abortion in Italy and to support the weak form of conventional comprise adopted by the Italian legislation to balance the conflict between women’ autonomy and healthcare professionals’ moral integrity. Conversely, we showed how the “no correlation” argument fails to demonstrate the absence of a relationship between the number of conscientious objectors and waiting times for voluntary abortion, and that the limitations of the “no correlation” argument itself demonstrate how it is still difficult to describe the real effect of conscientious objection on the access to abortion services and to evaluate the suitability of conventional compromise to effectively balance conflicting moral principles. Further studies are needed to better describe the relationship between conscientious objection and waiting times for voluntary abortion. If new evidence would show that the increasing proportion of objectors does undermine the efficacy of the Italian law and the right of a woman to freely obtain a voluntary abortion, new ways will need to be found to address the conflict between moral principles and restrict the protection accorded to the principle of moral integrity. This would inevitably imply the need to constrain and to redefine the terms and conditions for claiming conscientious objection. (shrink)

In his Knowledge and Belief (1962), Hintikka establishes his system of epistemic logic with the KK (Knowing that One Knows, in symbols, Kp→KKp) principle (KK for short). However, his system of epistemic logic and the KK principle are grounded upon his strong notion of knowledge, which requires that knowledge is infallible, that is, it makes further inquiry pointless, and becomes ‘discussion-stopper’; knowledge implies truth, to wit, cognitive agents will not be mistaken in their knowledge; cognitive agents will be ‘perfect logicians’, (...) i.e. they have infinitive capability of logical inference. Hintikka calls the argument for KK from the strong notion of knowledge as the ‘transcendental argument’ for KK. Obviously, the strong notion of knowledge is far away from our ordinary conception of knowledge; based on such a strong sense of knowledge, epistemic logic has met the problem of logical omnipotence, and is difficult to apply in our ordinary cognitive practice. Jin Yuelin 金嶽霖 was a Chinese philosopher and logician. From 1914 to 1920 he studied at the University of Pennsylvania and Columbia University, and received his Ph.D. in political science from Columbia in 1920. From 1921 until 1925, he studied in Europe and visited Great Britain, Germany, France, and Italy, among other countries. During these years, he studied at the London School of Economics and Political Sciences and at the University of Cambridge. At the end of 1925, Jin returned to (...) China and soon became a professor at Tsinghua University, where he began teaching logic in 1926. After a brief review of the notions of necessity and a priority, this paper scrutinizes Kripke's arguments for supposedly contingent a priori propositions and necessary a posteriori propositions involving proper names, and reaches a negative conclusion, i.e. there are no such propositions, or at least the propositions Kripke gives as examples are not such propositions. All of us, including Kripke himself, still have to face the old question raised by Hume, i.e. how can we justify the necessity and universality of (...) general statements on the basis of sensory or empirical evidence? Interest in sensory atmospheres and architectural and urban ambiances has been growing for over 30 years. A key figure in this field is acclaimed German philosopher Gernot Böhme whose influential conception of what atmospheres are and how they function has been only partially available to the English-speaking public. This translation of key essays along with an original introduction charts the development of Gernot Böhme's philosophy of atmospheres and how it can be applied in various contexts such as scenography, commodity aesthetics, (...) advertising, architecture, design, and art. The phenomenological analysis of atmospheres has proved very fruitful and its most important, and successful, application has been within aesthetics. The material background of this success may be seen in the ubiquitous aestheticization of our lifeworld, or from another perspective, of the staging of everything, every event and performance. The theory of atmospheres becoming an aesthetic theory thus reveals the theatrical, not to say manipulative, character of politics, commerce, of the event-society. But, taken as a positive theory of certain phenomena, it offers new perspectives on architecture, design, and art. It made the spatial and the experience of space and places a central subject and hence rehabilitated the ephemeral in the arts. Taking its numerous impacts in many fields together, it initiated a new humanism: the individual as a living person and his or her perspective are taken seriously, and this fosters the ongoing democratization of culture, in particular the possibility for everybody to participate in art and its works. Die Wissenschaften erzeugen mit neuem Wissen gleichzeitig auch verschiedene Formen des Nichtwissens. Dieser scheinbar paradoxe Zusammenhang der "Ko-Produktion" von Wissen und Nichtwissen wird in der Wissenschaftsforschung in jungster Zeit zunehmend anerkannt. Mit dem Konzept "Nichtwissenskulturen" lasst sich sowohl theoretisch begreifen als auch empirisch analysieren, wie wissenschaftliche Erkenntnispraktiken mit dem Wissen zugleich neue Raume gewussten wie nicht-gewussten Nichtwissens hervorbringen. Wissenskulturen sind daher auch Nichtwissenskulturen, die sich anhand spezifischer Charakteristika ebenso voneinander unterscheiden wie vergleichen lassen. Die unterschiedlichen Nichtwissenskulturen stellen wichtige Bezugspunkte in (...) den offentlich-politischen Debatten uber den Umgang mit Nichtwissen dar. In diesen Nichtwissensdiskursen kann die Anerkennung einer Pluralitat gleichrangiger Nichtwissenskulturen wichtige neue Perspektiven und Reaktionsmoglichkeiten eroffnen. Jin Yuelin’s logical and philosophical thought was deeply influenced by the philosophy of Bertrand Russell. The same influence existed also in the case of his view on truth, which was considerably close to the views maintained by Russell in his phase of logical atomism. In their investigations, Russell and Jin not only focused on similar topics, but also occupied similar philosophical positions, such as realism in the domain of ontology, empiricism in epistemology, and the correspondence theory in the domain of (...) the theory of truth. Nevertheless, Jin Yuelin’s view on truth was not only a mere imitation or recapitulation or even plagiarized copy of Russell’s, but also contained innovations and characteristics of its own. Jin, for example, emphasized certain general characteristics of truth, including the notion of truth as a relational quality, that truth is not a matter of degree, and that it is relative neither to time and space nor to the different types of knowledge. By so doing, Jin underlined the objectiveness, reliability, and transcendence of true propositions. By arguing that the correspondence theory of truth possessed strong foundations in common sense, Jin set out to defend the role of common sense in philosophy and science, maintaining that the former cannot be completely eliminated and arguing against the notion that any modification of a part of common sense would ultimately be founded on yet another segment of common sense. Moreover, Jin delivered his own response against the theory of the gap between “subject and object/the internal and the external,” which had been used to question the correspondence theory of truth, proposing a variety of cognitivist theory, which defined facts as “the given” (datum) that has been received and arranged. Most importantly, facts are cognitive constructs created on the basis of “the given” and encapsulate both subjectiveness and objectiveness. Jin Yuelin was a modern Chinese philosopher who had achieved profound erudition in both Chinese and Western thought, and, above all, an independent an profoundly original thinker. (shrink)

There are two problematic assumptions in Kripke’s semantic argument against descriptiv­ism. Assumption 1 is that the referential relation between a name and its bearer is only a metaphysical relation between language and the world; it has nothing to do with our public linguistic practice. Assumption 2 is that if name N has its meaning and the meaning is given by one description or a cluster of descriptions, the description(s) should supply the necessary and sufficient condition for determining what N designates; (...) it is possible for us to find out such a condition for fixing the referent of N. Emphasizing the sociality, conventionality and historicity of language and meaning, this paper criticizes Assumption 1 and Assumption 2, and concludes that Kripke’s semantic argument fails. (shrink)

This paper argues for a hybrid and alternative theory of names—Socio-historical Causal Descriptivism, which consists of six claims: (1) the referring relation between a name and an object originates from a generalized “initial baptism” of that object. (2) The causal chain of the name N firstly and mainly transmits informative descriptions of N’s bearer. (3) The meaning of N consists of an open-ended collection of informative descriptions of N’s bearer acknowledged by a linguistic community. (4) With respect to practical needs (...) of agents there is s weighted order in the collection of descriptions of N’s bearer. (5) The meaning or even partial meaning of N, together with the background of a discourse, the network of knowledge, speaker’s intention, etc., determines the referent of N. (6) All names have their own referents, including physical individuals, and parasitic, fictional, or intensional objects; there are few names absolutely without reference. (shrink)

To systematically answer two questions “how does language work?” and “where does linguistic meaning come from?” this paper argues for SocialConstructivism of Language and Meaning which consists of six theses: the primary function of language is communication rather than representation, so language is essentially a social phenomenon. Linguistic meaning originates in the causal interaction of humans with the world, and in the social interaction of people with people. Linguistic meaning consists in the correlation of language to the world established by (...) collective intentions of a language community. Linguistic meaning is based on the conventions produced by a language community in their long process of communication. Semantic knowledge is empirical and encyclopedic knowledge distilled and condensed, and the uses of language accepted by a linguistic community. Language and meaning change rapidly or slowly as the communicative practice of a linguistic community does. The crucial point of SCLM is to focus on the triadic relation among language, humans and the world, rather than the dyadic relation between language and the world. (shrink)

A group of Sogdian documents from the area of Khotan was recently acquired by Renmin University of China, Beijing. Four economic documents were edited in JAOS 130/4 ; the present article, comprising the edition of one complete letter and several fragments of letters, completes the publication of this collection, which adds to a growing body of evidence for the presence of Sogdian-speakers on the trade routes to the south of the Taklamakan desert.

This paper divides the sophisms and paradoxes put forth by Chinese thinkers of the pre-Qin period of China into six groups: paradoxes of motion and infinity, paradoxes of class membership, semantic paradoxes, epistemic paradoxes, paradoxes of relativization, other logical contradictions. It focuses on the comparison between the Chinese items and the counterparts of ancient Greek and even of contemporary Western philosophy, and concludes that there turn out to be many similar elements of philosophy and logic at the beginnings of Chinese (...) and Greek civilizations. ABSTRACTBy means of critical reflection on the current situation of Chinese philosophy, this article aims to clarify two different approaches to philosophy. One is for scholars to focus on original texts and thought tradition, concerned with interpretation and inheritance; even in this way, scholars can achieve theoretical innovation through creative interpretation. The other is for researchers to face up questions from academics and from reality, and mainly to do theoretical creation in philosophy on a profound theoretical background, strictly following academic (...) norms and standards. For contemporary Chinese philosophy, the two approaches are indispensable, but the serious problem is that the first approach absolutely is dominant, but the second is too weak. The correct choice of Chinese philosophy should be to let hundreds of flower bloom, to let different approaches compete with each other, and to cooperatively establish the prosperity of contemporary Chinese philosophy. The debate on the yan-yi relation was carried out by Chinese philosophers collectively, and the principles and methods in the debate still belong to a living tradition of Chinese philosophy. From Yijing, Lunyu, Laozi and Zhuangzi to Wang Bi, "yi" which cannot be expressed fully by yan, is not only "idea" or "meaning" in the human mind, but is also some kind of ontological existence, which is beyond yan and emblematic symbols, and unspeakable. Thus, the debate on the yan-yi relation (...) refers firstly to metaphysics, secondly to moral philosophy, and then to epistemology and philosophy of language. Guided by this view, this paper recalls the source of the debate on the yan-yi relation to Yijing and Lunyu, distinguishes four meanings of "yi" in Chinese philosophy, and reconstructs three arguments. These arguments are the "yan cannot express yi fully" argument, "forget yan once you get yi" argument, and "yan can express yi fully" argument. Finally, this paper exposes and comments on those principles, methods and the general tendency shown in the debate from the following five aspects: starting point, value-preference, methodology, texts, and influences. The inscription edited in this paper is the third bilingual Chinese-Sogdian epitaph to be made known, following that of Wirkakk and Wiyusi and that of Nanai-vande and Kekan, published in 2005 and 2017 respectively. The new epitaph is that of a Sogdian lady who died in 736 CE. Apart from its linguistic interest, it is important as attesting the conversion of a Sogdian lady to the “heretical” Buddhist Sanjie or “Three levels” movement, which remained popular despite being officially suppressed under (...) the Tang. In Yizhuan’s interpretation of The Book of Changes, the book’s fundamental concepts, xiang 象 and ci 辞, play different roles. Concepts, including yin and yang, firmness and gentleness, sancai 三才, and the wuxing 五行, are used to interpret The Book of Changes through the interpretation of images, while the core Confucian values, such as benevolence and righteousness, are used to interpret The Book of Changes because of their connection with words of gua and yao. In order to expand the meaning (...) of the words of gua and yao, Yizhuan sometimes connects words with images; in other occasions, however, it simply takes these words as independent guides. The Confucian scholars who wrote Yizhuan, therefore, not only revered the classic, but also used it to send their own message. Out of reverence, they “shu 述 ”; in using it, they “zuo 作 ”. The combination of recitation and creation made the words of gua and yao very flexible in the process of interpretation, while the interpretation changed the meaning of the classic to a great extent. Researchers have consistently identified the disparity between teachers’ practical and legal knowledge regarding teachers’ right to discipline students. However, few studies have investigated teachers’ construction processes that form construction outcomes, which would help navigate the role of legislation in school discipline. This study contributes to a holistic picture of the neglected disciplinary rights that teachers construct in teaching practice and their underexplored attitude toward the law, using an interview-based constructionist method on twelve teachers of Lvliang city in a Chinese K-12 (...) context. The findings suggest that the participants prefer to acquire discipline knowledge by interacting with multiple power relations in their local environment and that their knowledge is historically and culturally specific. Although the disciplinary right they construct is never static, balanced, or essentialised, the participants’ constructions are commonly not in line with legal provisions or the aims of the law. Furthermore, school discipline legislation plays a silent role in empowering teachers to discipline students, but it is more visible in holding back teachers’ use of corporal punishment. These findings illustrate the complexity of implementing school disciplinary law as a universal national policy. (shrink)

Abstract:In the Chinese cultural imaginary, the road (Dao, “way”), especially trade routes, has always been an important metaphor for changing circumstances including shifting ideological grounds. Its own life trajectory is both classical and contemporary, and its emergence predates the trains, nation-states, sovereign powers, and so on, all such signs of techno-political modernity at work. Also in that regard, spiritually inflected images of the “West Heaven,” also an old name for India, where Buddhism originated, have always been present in East Asian (...) cultural spheres, which, in turn, points to the presence of a deeper Eurasian world connected through the Middle East as well. Now, however, quite strikingly, such global conceptual structures, long part of the evolving Chinese cultural tradition too, are being rapidly localized and recast into something else. For example, in China, Buddhism, a religion fundamentally critical of idol worshipping, has become pantheistic, and the political ideas that originally promoted equality newly patriarchal. For those living along the China Eastern Railway tracks in the twenty-first century, all such ideologies have become part of a tensional fight of gods in which they, too, are caught: on one hand they long for a linear progression of society that would never turn back, but on the other hand they are reluctant to abandon the self-comforting theory of reincarnation. This is also how they come to praise the imported concept of the motherland while worshipping figures of traditional patriarchal power. (shrink)
